These terms apply to subscribers to the services provided by “Woogamble.com” (referred to in these Terms and Conditions as “we”, “us” and “our”). The services and “Browser “are both operated by Woogable Limited a company registered in England, company registration number 08976819, registered office at: Suite 225, Legacy Business Centre, 2A Ruckholt road, London, E10 5NP.
Changes to these terms: We may revise these Terms by posting an updated version to this web page to reflect changes in market conditions affecting our business, changes in technology or our business model, changes in relevant laws and regulatory requirements, and changes in our systems.

What we do:
We are a provider of FREE VPN services. All traffic you send goes via secure tunnel to our servers and is then re-translated further to the internet. Using this scheme, we are changing your IP address by the IP addresses of our servers.
In addition, we provide Free VPN Downloadable Browser for desktop Personal Computers (“PCs”) and applications for mobile devices.

By registering to use our VPN Service you confirm that:
a) you will provide accurate and complete registration data (if requested) and that you shall inform us of any changes in your registration data;
b) you are legally capable of entering into binding contracts
c) if you are acting for an organisation (such as a company or a partnership), you are authorised to enter into these terms for and on behalf of that organisation (in which case, references in these terms to “you” are to that organisation, and not you personally); and
d) by accessing and using our Browser and the services on our Browser, you are complying with all applicable laws and regulations in the country in which you are located.
Access & registration:
We restrict access to our VPN Service to users who have registered with us and who have an active subscription.
We have the right to suspend or close any account with us and block your use of our VPN service and Browser, if (in our opinion) you have failed to comply with any part of these terms.
You are responsible for ensuring that all persons who use your account with us are aware of these terms, and that they comply with them.
You are responsible for all use of your security details and your account. You must treat your username and password, and any other security details, as confidential, and not disclose it to any other person. You must also prevent unauthorised access to your account
Our VPN Browser and services are free to use for private, non-commercial purposes.
Third party advertisements
To keep our services free, we allow the right to display and show in our Browser and website banners, advertisement and links of third parties websites/organisations.
We are not carrying any responsibility for the content, security and nature of any third parties websites that linked from our website via banner or other advertisement. We accept no liability for any loss, howsoever caused by your use of or inability to use any third party websites/organisations or services. In accepting these Terms, you agree that you are entering linked websites at your own risk.
Where our Browser or Software contains links to other websites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility or liability for them or for any loss or damage that may arise from your use of them.
Using our services:
The Product is provided on the terms “as is”. We makes no warranties in respect to the work of the Software or our Services, its compliance with specific goals and expectations of the User, as well as no other warranties that are not directly stated in these Terms..
Viruses, hacking and other offences
You must not misuse our Browser or VPN Service by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful.
You must not attempt to gain unauthorised access to, interfere with, damage or disrupt, our Browser, our VPN Service the servers, equipment or network on which our Browser or VPN Service is hosted, any software used in the provision of our Browser or VPN Service or any server, computer or database connected to our Browser or VPN Service. You must not attack our Browser or VPN Service via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Browser or VPN Service will cease immediately.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Browser or VPN Service or due to you downloading any software or material posted on it, or on any website linked to it.
You agree to use our services only for activities and agree not to including but not limited to:
i. in any way breach any applicable local national or international law or regulation;
ii. engage in any activity connected with hacking, virus transmitting and mass mailing or unauthorised advertising promotional materials ( “spam”, “junk mail”, chain letters”, pyramid schemes) or activities;
iii. transmitting any harmful, unlawful, threatening, terror connecting information and content.
iv. attempt to cause harm, disruption of work of our servers, attempting collect information about logs or other personal information of our users;
v. attempt to copy partly or in whole our software for the purpose of harming or attempting to harm minors in any way;
vi. upload, post, email or otherwise transmit any content that is directed to inciting or producing imminent conduct that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libellous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable and is likely to produce such conduct;
vii. impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity;
viii. forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the system;
ix. upload, post, email or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
x. interfere with or disrupt our Browser’s system or servers or networks connected to our Browser’s system, or disobey any requirements, procedures, policies or regulations of networks connected to our Browser’s system;
xi. collect or store personal data about other users without their knowledge; or
xii. promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals.
All exclusive rights to the Products belong to the Woogable Ltd. We are the owner or the licensee of all intellectual property rights in our VPN Service and nothing in these terms shall grant you any rights, title or interest in and to such intellectual property rights
Woogable Ltd does not grant or assign to the user the exclusive rights to results of intellectual activity, including any related computer programs that are required for effective use of our Software and services.
If you copy or download any part of our Browser or of the Software in breach of these terms, your right to use our Browser, our VPN Service and the Software will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
i. During the development and use of the Product the rights of intellectual property, that belong to third parties, were used and/or are being used. Woogable Ltd lawfully uses these rights.

We will determine, in our discretion, whether there has been a breach of these terms through your use of our Browser or VPN Service. Failure to comply with these terms constitutes a material breach of the terms upon which you are permitted to use our Browser, our VPN service and our Software, and may result in our taking all or any of the following actions:
i. immediate, temporary or permanent withdrawal of your right to use our Browser, VPN Service and/or our Software with no refund of any monies paid;
ii. issue of a warning to you;
iii. instigate legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
iv. by instigating any legal proceedings we are not precluding recourse to the disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
The responses described in these terms are not limited, and we may take any other action we reasonably deem appropriate.
Our VPN service and Software is provided on an “as is” basis without any guarantees, conditions or warranties as to its quality or suitability for any particular purpose. We hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and make no representation or warranty, express or implied, as to the accuracy or completeness or satisfactory quality or fitness for a particular purpose of our VPN Service or the Software. To the extent permitted by law, and subject to the exceptions below, we hereby expressly exclude liability for all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity, any direct, indirect or consequential loss or damage incurred by you or any user in connection with our VPN Service and/or the Software, or in connection with the use, inability to use, or results of the use of our VPN Service, any websites linked to it and any materials posted on it, including, without limitation any liability for:
This provisions of this Clause 8 do not limit or exclude our liability for death or personal injury arising from our negligence, nor our liability for fraud or fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.
These terms and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of any contract.
Each of us agrees that our only liability in respect of those representations and warranties that are set out in these terms (whether made innocently or negligently) will be for breach of contract.
This Agreement is governed by, and is to be construed in accordance with, English law and is agreed that any dispute disputes arising out of or in connection with these Terms will submit to the exclusive jurisdiction of the courts of England and Wales.

Once you go online using our browser the internet connection is established between your internet service provider and our internet service provider. Everything you do online is ‘encrypted’ and essentially anonymous; anyone trying to break into your internet connection to steal your data (e.g. on public Wifi networks) will not be able to because your web traffic is securely hidden. 1. GENERAL CONDITION
1.1. This license agreement (“the Agreement”) establishes the rules and conditions of the use of a computer program – Woogamble Browser (“the Product”) and is being concluded between any person using the Product on any grounds and conditions (“the User”) and Woogable Ltd (“the Right Holder’’).
The Right Holder – Woogable Ltd, having its registered office at 81 Broadlands Road, Southampton, SO17 3AP, England.
The Product – the computer program, its elements created by the Right Holder himself or through third parties and distributed by the Right Holder with indication that they purport to be the Woogamble Browser.
1.2. The Agreement is deemed to be concluded upon copying, or installation on a private (personal) device(s) of the User, or beginning of use, or other actions performed by the User with respect to the Product, associated with the use of the latter.
1.3. Performing any of the actions specified in paragraph 1.2 of the Agreement the User accepts fully and without exceptions the terms of the Agreement and undertakes to comply with them. Thus:
- the User guarantees that it is not subject to any restrictions under the laws of country of his (her) residence or the country of his (her) citizenship and that he (she) has obtained all necessary permissions to use the product
- the User gives his (her) consent to the collection, storage, use by the Right Holder of all necessary information on the use of the Product by the User.
In case the User disagrees with any provision of this Agreement, he (she) has no right to use the Product or perform any actions with respect to it.
1.4. This Agreement shall be governed by the laws of the United Kingdom. Any dispute arising out of or in connection with this Agreement, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by the competent court at the location of the Right Holder in accordance with the substantive and procedural laws of the United Kingdom.
2. INTELLECTUAL PROPERTY
2.1. All exclusive rights to the Product belong to the Right Holder.
2.2. The Right Holder does not grant or assign to the User the exclusive rights to results of intellectual activity, including any related computer programs that are required for effective use of the product.
3. USE OF THE PRODUCT AND THE LICENSE
3.1. The product is designed to automate actions of the User on the installation of secured VPN connection for the purpose of access to online resources, which can be blocked by Internet service provider. Use of the Product by the User shall be on a free-of-charge basis.
3.2. The software product Woogamble @ Windows is supplied in a form of the installation program, developed on the NSIS (the license text is provided in the annex hereof). The following components of the Product shall be installed on a personal device of the User:
b. Woogamble Browser, which is developed on the basis of Chromium (the license text is provided in the annex hereof);
c. OpenVPN client (the license text is provided in the annex hereof);
d. Woogamble Service – Windows Service, performing the control of the state of the VPN connection. Woogamble Service manages the configuration of OpenVPN, downloads certificates and connection settings, starts / stops OpenVPN service.
e. Woogamble Agent – tray application designed for interaction with Woogamble Service.
3.3. The Product supports the automatic updating of components.
The Product may at any time automatically download and install updates, which are aimed to its improvement and can be in any form, including patches, additional modules and completely new versions.
The User hereby acknowledges and agrees with automatic updates of the Product, including the request for download and installation of updates of the Product on personal device of the User without any further notifications. The User also acknowledges and agrees that the relative updates are subject to this Agreement, unless otherwise specified by an update.
3.4. The product can be used by the User only for personal, non-commercial purposes.
3.5. Subject to the terms and conditions of this Agreement the Right Holder grants the User on a free-of-charge basis a non-exclusive license to use the Product in the following ways:
- for its intended functional purposes, including the installation on personal device(s);
- launching and work with the Product;
- carrying out actions necessary for the operation of the Product in accordance with its purpose, including recording and storage in memory.
3.6. The User may not:
- use the Product by means other than specified in the Agreement;
- reprocess, make changes to the Product without prior consent of the Right Holder.
3.7. This Agreement shall apply to all future updates/new versions of the Product.
3.8. The Product may be used on the operating system Android (license text to the library used is provided in the annex hereof).
3.9. The Right Holder is entitled to independently without prior notification of the User at any time suspend the operation of the Product to technical and/or other reasons at the discretion of the Right Holder.
4. RIGHTS OF THIRD PARTIES
4.1. During the development and use of the Product the rights of intellectual property, that belong to third parties, were used and/or are being used. The Right Holder lawfully uses these rights.

5. LIABILITIES OF THE PARTIES
5.1. The Product is provided on the terms “as is”. The Right Holder makes no warranties in respect to the work of the Product, its compliance with specific goals and expectations of the User, as well as no other warranties that are not directly stated in this Agreement.
5.2. The Right Holder shall not be liable for any direct or indirect consequences of any use of inability to use the Product and/or damage caused to the User, his (her) personal devices, software, other property and/or third parties as a result of any use or non-use of the Product, including possible errors or malfunctions of the Product.
5.3. In case of violation by the User of this Agreement or other rules established by the Right Holder, the latter has the right to unilaterally restrict the use of the Product by the User, as well as to refuse to the User further use of the Product without reimbursement of any compensation to the user.
6. CHANGE OF TERMS OF THIS AGREEMENT
6.1. This Agreement may be changed unilaterally by the Right Holder. The Right Holder notifies the User about changes of the terms of this Agreement by any of the following methods:

The changes in the terms of this License Agreement shall enter into force on the date of their publication, unless otherwise specified in the relevant publication.
